Rahul Gandhi has not got any relief in the defamation case regarding Modi surname. The order has been reserved by the High Court, due to which the decision can come after the vacation. Purnesh Modi’s lawyer argued in the court on Tuesday. On the other hand, Rahul Gandhi’s lawyer Abhishek Manu Singhvi also presented arguments citing the decisions of different cases. He argued that the surname of the Prime Minister is ‘Modi’, the position of the Prime Minister is high but this is not the concept of the complaint or the matter. Among crores of people with Modi surname, no one got hurt, only one very sensitive person got hurt.

Arguments of both sides were completed in the court

Purnesh Modi’s lawyer said that Rahul Gandhi had said in his speech that Narendra Modi is not a chowkidar; They loot the money of the country. Nirav Modi and Lalit Modi, Vijay Mallya and Mehul Choksi have also run away with money. 30 thousand crores of people were looted. The lawyer argued that Rahul Gandhi said in his speech, ‘I am Gandhi, not Savarkar, Gandhi will not apologise’. I am not afraid of jail, disqualification. If you are not afraid to speak whatever you want then there is no need to come here. Rahul Gandhi had also taken the name of the Prime Minister in the Rafale deal. Rahul talking about not apologizing publicly and praying in court is contradictory behaviour. When you publicly say that all Modi’s are thieves, the Prime Minister’s surname is also Modi. You defame the Prime Minister in front of people.

In the last hearing, during the hearing in the court, the defense lawyer Abhishek Manu Singhvi had argued. He argued that this is not a serious offense which cannot be forgiven. We are demanding a stay on the conviction. In case of non-recognition such complaint cannot be filed. A person who was not named in the statement filed a complaint. Rahul Gandhi is also a public representative and MP. If the Election Commission announces the election, how can the court withdraw that decision?” The plea was given to stay the lower court’s decision that there are crores of Modis in the country, why no one complained.

No evidence was examined after the complaint

In the last hearing, Rahul Gandhi’s lawyer Abhishek Manu Singhvi placed several issues before Justice Hemant Pracharak in the High Court. In which no offense is made out on the basis of WhatsApp cutting. Pen drive was produced, which is not mentioned in the complaint. There is also no 65-B certification to support recording. The CD release also has an interesting story. There was no mention of CDs from 2019 to 2021. Suddenly CD of 2021 was released. Singhvi argued that on conviction in such cases, there could be a jail term of 3 to 6 months, but not 1-2 years. For the first offence, the punishment may not exceed 2 years. If the sentence is not stayed, the political career of the petitioner may end.
