Surat: It is mandatory for a woman to be present at the time of delivery, not a man: Court

It is necessary for the woman to be with the woman at the time of delivery, it is not necessary for the man to be there. Commenting thus, the Sessions Court dismissed the petition seeking interim bail for the delivery of the pregnant wife of a murder accused.

According to the information received from the court sources, on 28-7-2021, a youth named Sanjay Vaniya (resident of Bhagwan Nagar, Katargam) was murdered near Dabholi Char Rasta. Convicted accused in this crime Prashant Chandrakant Rajput (23 resident of Prabhu Nagar Katargam) had sought interim bail to stay with his eight months pregnant wife at the time of delivery. In which Advocate Digant Tewar appeared on behalf of the Government and Advocate Ashwin Jogadia appeared on behalf of the original complainant and protested. He told that in June-2022, the accused had got one week’s bail for the marriage but after the expiry of the bail period, the accused had absconded.

After hearing both the sides, the court said that the in-laws and maternal side of the pregnant woman can take care of her. Looking at the details of the documents presented in the court, the wife of the accused is being treated on time. In such cases, it is mandatory for the woman to be present at the time of delivery, there is no need for the man to be present. Earlier, the accused did not appear in jail on time. This Court observed that if the accused is released on interim bail, the accused would be a permanent absconder and if that happens, the complainant and the deceased would be deprived of justice. Therefore, the court refused to grant interim bail to the accused.
